Having been accused of imposing“unreasonable conditions”in the App Store , Apple has been steady accumulating a higher and higher fine in the Netherlands : the total now stands at € 25 K ( some £ 21 m ) and will soon reach € 30 m. The competition authority ACM continue to say that Apple hasfailed to satisfy the requirementsset out in the injunction from last year that was upheld in motor lodge on Christmas Eve .

But the company appears to remain largely unrepentant , and believes it is following the linguistic rule . In a new letter to the ACM obtained by9to5Mac , Kyle Andeer ( credit as Apple ’s Chief Compliance Officer ) write that the company believes it complies with the ACM ’s requirements .

“ Apple believes its solvent is fully compliant with Dutch law , ” Andeer writes . “ Apple has a consistent and longstanding committedness to compliance in each and every country in which we do business . We take these obligations very badly . ”

He explains in point why the society does not look at the requirement for a separate app binary single file for the Netherlands to be something to get attend up on .

“ Developers routinely offer disjoined binary for dissimilar jurisdiction , ” Andeer argues . “ It it is not simply potential , but common , for a developer to put in different versions of the same app in different nation .

“ A new binary for the Dutch storefront would just require a venial technical change to an existing app consisting of a circumscribed fitting that allows a developer of a dating app to apply a third party payment central processing unit or insert a link to a website for purchase . There are no additional costs associate with this feeler . ”

As evidence of this , Andeer points to the fact that many developer already have disjoined versions of the same app for dissimilar securities industry . These admit Match Group , whose go out apps are among those affected by the ACM ’s determination . Match Group has had no job uploading these freestanding files , which often have large differences than those need to expend alternative payment solutions in the Netherlands , Apple claims .
